1. Acceptance

FasterAudio Material is defined as any documents, software, products, web links, email, information, or any other materials provided by FasterAudio in any way.

2. Use of FasterAudio™ Material

A. Generally
You agree not to use any FasterAudio Material for any purpose which is against any law in your jurisdiction or for any purpose which would not give full effect to the Terms even if that purpose is otherwise allowed under the Terms of this agreement.

You may view the Site using a web browser for evaluation purposes as a potential customer, supplier, or affiliate.

Programs
FasterAudio retains the right to make changes to its Affiliate Program or other programs as it sees fit.

All Affiliate Program payment schedules and percentages are subject to change without notice. FasterAudio also retains the right to terminate its relationship with any Affiliate or program partner at any time without penalty.

Restrictions
To the maximum extent allowable under applicable law, you agree not to publish, re-publish, lend, license, give away, look at the software source code, modify the software source code, post to an Internet web site or create derivative works of the contents of this Site, nor will you allow or assist a third party to do so without FasterAudio's prior written permission.

Trademarks
Unless otherwise noted in the contents of this website, all names, logos and marks appearing in this website are trademarks owned or used under license by FasterAudio or its affiliates. Other trademarks are the property of the respective trademark's owner. Unauthorized use of any trademark or content on this website is strictly prohibited. Windows is a registered trademark of Microsoft Corporation in the United States and other countries.

Assignment
This agreement cannot be assigned.

Ownership of Intellectual Property
FasterAudio DOES NOT transfer to you title to any FasterAudio Material. All ownership, copyright and other intellectual property rights to any FasterAudio Material belongs solely to FasterAudio and its suppliers except as expressly licensed in these Terms.

Without reducing or restricting any other remedies that FasterAudio may be entitled to, you agree that to the extent allowable under applicable law any automated system using any FasterAudio Material will be the property of FasterAudio.

Client Privacy
FasterAudio does not share customer information of any kind with anyone. We will not sell or rent your name or personal information to any third party. We DO NOT sell, rent or provide outside access to our mailing list.

FasterAudio only collects such personal information that is necessary for you to access and use our Site, or Software. This personal information includes, but is not limited to, first and last name, email address, physical address, zip code, phone number, credit card information, and other personal information necessary to purchase and issue a license for Software.

FasterAudio may release personal information if FasterAudio is required to by law, search warrant, subpoena, court order or for fraud investigation.

We may also use personal information in a manner that does not identify you specifically nor allow you to be contacted but does identify certain criteria about our Site's users in general (such as we may inform third parties about the number of registered users, number of unique visitors, and the pages most frequently browsed).

Prices for Software are subject to change without notice.

Refund Policy
Once a person has purchased a license, they are automatically given an Activation Key to complete the installation. While our software should enable almost everyone to be able to install FasterAudio on a PC computer with Windows 2000, Windows Millennium Edition (Me), Windows CE, Windows XP, and Windows Vista operating system, FasterAudio cannot warrant that any specific customer will be able to do so.

If you are unable to install FasterAudio on a PC running Microsoft Windows 2000 or newer operating systems, and if our support help desk is unable to resolve the installation problem, you can notify us of your inability to install FasterAudio by issuing a Refund Request support ticket located at: http://www.FasterAudio.com/support and we will refund 100% of your money after verification the Actication Key issues with your purchase has not been activated.

If you choose to request a refund within the first 30 days you must notify FasterAudio by issuing a Refund Request support ticket available at: http://www.FasterAudio.com/support and we will refund 100% of your money.

Refund requests made after 30 days from purchase do not qualify for any refund. Refund requests over informal email are not accepted. Please allow at least 2-3 weeks for refunds of, credit card or PayPal payments.

LIMITED WARRANTIES
Except as expressly provided in these Terms, to the maximum extent permitted under applicable law, FasterAudio Material is provided "as is" without any kind of warranty.

You accept full responsibility for determining whether FasterAudio Software is suitable for any particular purpose.

Except as expressly provided in these Terms, we are not responsible for any loss, injury, claim, liability, damage, or consequential damage related to your use of Site Material, whether from errors or omissions in the content of Site Material or any other linked sites or for any other reason. Use of Site Material is at your own risk.

FasterAudio does not represent or warrant that Site Material, its server or any linked sites are free of any harmful materials.

Maximum Liability
Except as expressly provided in these Terms, the maximum liability of FasterAudio is the amount paid to FasterAudio by the customer.

Guarantees
The amounts specified in this section are the limits to any guarantees provided in any Site Material.

Indemnification
The user agrees to indemnify and hold FasterAudio, its directors, officers and employees, harmless from any claim, demand, or damage, including legal fees, asserted by any third party due to or arising out of the user's use of or conduct on the Site.

Modification to Terms
FasterAudio reserves the right to change the Terms or policies regarding the use of the Site at any time and to notify you by updating the Site.

Severability
The invalidity or unenforceability of any provision of these Terms or the Site's Disclaimer will not affect the validity or enforceability of any other provision of these Terms or the Site's Disclaimer and such invalid provision will be deemed to be severable.

Whole Agreement
The Terms and the Site's Disclaimer constitute the whole agreement between you and FasterAudio.

Waivers
No failure or delay, on the part of FasterAudio, in exercising any right or power under these Terms will operate as a waiver of such right or power.

Governing Law
The Terms are governed by the laws of the Province of British Columbia in Canada. You consent to the exclusive jurisdiction of the courts of the Province of British Columbia, Canada.
